Information Clause regarding the protection of personal data at Naftoserwis sp. z o. o.
In accordance with Article 13 paragraphs 1-2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter “GDPR”), we inform you that:
- PERSONAL DATA CONTROLLER
The Controller of your personal data is Naftoserwis Sp. z o.o. with its registered office in Warsaw (address: ul. Finlandzka 10, 03-903 Warsaw), hereinafter referred to as the Company. For any matters related to the processing of your personal data, you can contact the Personal Data Controller by email: sekretariat@naftoserwis.pl or by writing to the Company’s registered office address.
- LEGAL BASIS AND PURPOSES OF PERSONAL DATA PROCESSING
We will process your personal data:
- for the purpose of conducting the recruitment process, based on the authorization arising from Article 22¹ of the Labor Code, in the following scope: name and surname, date of birth, contact details, education, professional qualifications, and previous employment history. The basis for processing the above-mentioned personal data is a legal obligation (Article 6, paragraph 1, point c of the RODO),
- for the purpose of conducting the recruitment process, based on your consent to the processing of your personal data, i.e., personal data other than those indicated in the point above, provided in your CV, application form, cover letter, and other documents. The basis for processing is the aforementioned consent (Article 6, paragraph 1, point a of the RODO),
- to pursue the legitimate interest of the controller in the data obtained from you during the recruitment process in connection with verifying your skills and abilities required for the position specified in the job advertisement. The basis for processing this data is our legitimate interest (Article 6, paragraph 1, letter f of the RODO),
- to pursue the legitimate interest of the controller in the event of a legal need to prove facts or demonstrate compliance with obligations (Article 6, paragraph 1, letter f of the RODO),
- DATA RECIPIENTS
Your personal data will only be collected by entities authorized to obtain them under applicable law and by processors who provide services to the Data Controller and to whom these data are entrusted.
- DATA STORAGE PERIOD
Your personal data will be processed until the recruitment process is completed, but no longer than for a period of 6 months from the date of completion of the recruitment process or until your consent is withdrawn.
- DATA SUBJECT RIGHTS
Under the RODO, you have the right to:
- request access to your personal data from the Data Controller pursuant to Article 15 of the RODO;
- request rectification (correction) pursuant to Article 16 of the RODO;
- request restriction of personal data processing pursuant to Article 18 of the RODO;
- request erasure of personal data pursuant to Article 17 of the RODO;
- port personal data pursuant to Article 20 of the RODO;
- withdraw consent to personal data processing by submitting/sending a letter to the Data Controller;
- file a complaint with the President of the Personal Data Protection Office.
- object to the processing of personal data processed pursuant to Article 6(1)(f) of the RODO, as indicated above in point III.
The above requests can be sent to the addresses indicated in points I and II.
- INFORMATION ON DATA TRANSFER TO THIRD COUNTRIES OR INTERNATIONAL ORGANIZATIONS
Your personal data will not be transferred to a third country or international organisations.
- AUTOMATED DECISION MAKING
Your personal data will not be used for automated decision-making, including profiling.
- POSSESSION OF PERSONAL DATA
Your personal data, including your name, date of birth, contact details, education, and previous employment history, is required to participate in the recruitment process. Providing the remaining personal data is voluntary.
- ENTRUSTING DATA PROCESSING
The personal data of the other Party may be transferred to entities processing personal data at the request of each Party, including, among others, those operating IT systems used for the purpose of implementing the contract, providing accounting, postal, archiving and legal services, and such entities process data on the basis of an agreement with one of the Parties and only in accordance with its instructions. Data may also be shared with entities authorized by law, including tax authorities. Data will be processed for the duration of the contract, and after its termination, for a period related to the expiration of claims related to the contract, and for a period specified by tax and financial reporting regulations.
- RIGHT TO WITHDRAW CONSENT
You have the right to withdraw your consent to the processing of your personal data at any time. Withdrawal of consent does not affect the lawfulness of processing based on your consent prior to its withdrawal. You can send your declaration of withdrawal of consent to the processing of your personal data to the addresses indicated in points I and II.
In your CV or documents sent in connection with the recruitment process, please include:
“I consent to the processing of my personal data contained in the documents I have provided related to the recruitment process at Naftoserwis sp. z o.o. (ul. Finlandzka 10, 03-903 Warsaw), for the purpose of carrying out the recruitment process in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. I provide my data voluntarily, being aware that I have the right to withdraw this consent at any time. A request to withdraw consent means that I am resigning from further participation in the recruitment process and will result in the immediate deletion of my data and does not affect the lawfulness of processing based on consent before its withdrawal.”
If you wish to participate in subsequent recruitment processes conducted by the Company, please add the following clause:
“I consent to the processing of my personal data for the purposes of future recruitment processes conducted by Naftoserwis Sp. z o.o..”
In such a case, your personal data will be stored until your consent is withdrawn.
